1. Acceptance

By accessing or using Real Offer, you agree to these Terms of Service.

If you do not agree, do not use the platform.

2. Description of Service

Real Offer provides software that enables users to create, submit, manage, negotiate and track property purchase offers electronically.

Real Offer is a technology platform only.

Real Offer is not:

• A real estate agency
• A law firm
• A financial adviser
• A mortgage broker

3. User Accounts

Users must:

• Provide accurate information
• Maintain account security
• Keep passwords confidential
• Notify us of unauthorised use

Users are responsible for activities conducted through their accounts.

4. Subscription Fees

Certain features require a paid subscription.

Subscription fees:

• Are billed in advance
• Are non-refundable except where required by law
• May change with prior notice

5. Cancellations

Users may cancel subscriptions at any time.

Cancellation prevents future billing but does not automatically generate refunds for previous billing periods unless required by Australian Consumer Law.

Promo codes may discount the price or start a free trial. Where a code starts a free trial, a card is required upfront and the plan price is charged automatically when the trial ends unless you cancel first.

6. User Content

Users retain ownership of content submitted to the platform.

By submitting content, users grant Real Offer a licence to host, process and display that content solely to provide the service.

7. Acceptable Use

Users must not:

• Upload unlawful content
• Infringe intellectual property rights
• Attempt to gain unauthorised access
• Interfere with platform operation
• Use the platform for fraudulent activity

8. Intellectual Property

All platform software, branding, logos and content remain the property of Real Offer or its licensors.

Users receive a limited, non-transferable licence to use the platform during an active subscription.

9. Availability

We strive to maintain service availability but do not guarantee uninterrupted operation.

Maintenance, outages and technical issues may occur.

10. Limitation of Liability

To the maximum extent permitted by law:

• Real Offer provides the platform "as is"
• We are not responsible for indirect, incidental or consequential loss
• Our liability is limited to amounts paid by the user in the previous 12 months

Nothing in these Terms excludes rights under Australian Consumer Law.

11. Indemnity

Users agree to indemnify Real Offer against claims arising from:

• Breach of these Terms
• Misuse of the platform
• Violation of applicable laws

12. Termination

We may suspend or terminate accounts that:

• Breach these Terms
• Engage in fraudulent activity
• Create security risks

13. Privacy and Buyer Information

Real Offer handles personal information in accordance with our Privacy Policy.

Where an agency uses the platform to collect information from prospective buyers or other parties to an offer, that agency is responsible for having a lawful basis to collect it and for giving those individuals any privacy notices or consents required by law. Real Offer processes that information on the agency's behalf to provide the service.

Users must not upload or submit another person's personal information without the authority to do so.

14. Governing Law

These Terms are governed by the laws of Queensland, Australia.

Any disputes shall be subject to the jurisdiction of Queensland courts.
